This matter falls within the scope of the cases that allow the coastal state to take executive measures against any foreign ship (carrying the flag of a state directly or indirectly involved in supporting or participating in the war), that is anchored in its territorial sea or passing through it towards the strait, to stop or detain it, in accordance with what is stipulated in Article 28/3. Because Yemen supports the Palestinian people and rejects the crimes of genocide committed against them today, its move to prevent foreign ships (whether Israeli by flying the flag, or of other nationalities but working for Israel) can be considered not to be in violation of maritime navigation laws.
Yemen has the right to target US warships in the Red Sea
The United States of America is considered, politically, militarily and security-wise, a hostile state to Yemen and is the primary instigator and supporter of the continuation of the regional and international blockade on the Yemeni people. It relies on the military presence of its forces in many countries neighboring Yemen (the Gulf states and up to the Horn of Africa), in addition to the military presence of its warships in the Red Sea from the Suez Canal to Bab al-Mandab.
Accordingly, this presence of US warships in the Red Sea can be considered:
- An aggressive presence whose goal (under the title of deterrence) is to threaten the security and safety of Yemen.
- Targeting Yemeni naval boats by US aircraft is a "declaration of war" and a "direct attack", which gives Yemen the right to use all means of legitimate self-defense in accordance with Article 51 of the UN Charter.

The presence of US warships and aircraft carriers in the Red Sea is not a transit passage (which can be considered free and therefore does not allow the coastal state to disrupt, prevent or confront it), but rather a non-innocent passage and, therefore, a threat to regional and international security and peace, which gives Yemen the right to confront.

- Emphasizing that the Israeli and American military presence in the islands and countries neighboring the Yemeni geographical borders, as well as the maritime space (a real presence that precedes what happened in Gaza and what is happening today), constitutes a threat to Yemen's security and vital interests, and therefore it is its right, as an independent sovereign state and a member of the United Nations, to demand that the international community take the necessary measures to stop the Israeli and American attacks that constitute a threat to international peace and security.
